A Montgomery County Judge, Steven O’Neill has declared a mistrial in the case against American stand-up comedian, Bill Cosby after a jury was unable to come to a unanimous decision.
Cosby, 79, was charged with three counts of aggravated indecent assault in an incident involving former Temple University basketball staffer Andrea Costand at his home in suburban Philadelphia in 2004.
After more than 52 hours of deliberations over six days, the jury confirmed to Justice O’Neill that they could not reach a unanimous decision on whether the 79-year-old actor drugged and molested Constand at his suburban Philadelphia home in 2004.
After hearing this, Justice O’Neill concluded on Saturday, June 17 that they could not reach a verdict.
“Do you agree that there’s a hopeless deadlock that cannot be resolved by further deliberations?” he asked after calling the jurors in a little after 10 a.m. EDT. All jurors said yes.
“After 52 hours of deliberation, which is probably one of the most courageous, selfless acts I’ve ever seen in the criminal justice system, I’m compelled to grant a mistrial,” Justice O’Neill ruled.
Meanwhile, prosecutors have promised to retry Cosby, who remains free on $1 million bail.
“We will revaluate and review our case and will retry it and move as soon as possible,” Montgomery County District Attorney Kevin Steele told reporters.
Speaking further, Steele praised the accuser, adding that the said she is “entitled to a verdict in this case.”
In a similar vein, Cosby’s wife, Camille slammed Steele and the Justice O’Neill after the mistrial.
Speaking after the judgment she said: “How do I describe the District Attorney? Heinously and exploitively ambitious.
“How do I describe the judge? Overtly and arrogantly collaborating with the District Attorney,” she said.
Also speaking after the mistrial, Cosby spokesman Andrew Wyatt said, “In the words of Huey P. Newton, power is the ability to define phenomenon, making it act in a designed manner,” Wyatt said.
“Mr. Cosby’s power is back… the jurors, they used their power to speak… Mrs. [Camille] Cosby’s power is back.
The spokesman also accused high-profile women’s rights attorney Gloria Allred of conspiring against Cosby.
“For all those attorneys, who conspire like Gloria Allred, tell them to go back to law school and take another class,” Wyatt said.
